RPI
of Indiana Inc. warrants to the original purchaser
that new roll-off, front and rear load containers
to be free from defects in material and workmanship
when used under normal operating conditions for
a period of three (3) months from the date of delivery,
subject to the conditions outlined below.RPI of
Indiana Inc.'s sole obligation under this warranty
is limited to repair or replacement of the product
provided we are notified within ten (10) days after
discovery of the defect, the product is returned
with transportation charges prepaid and in any event
not more than three (3) months after the date of
delivery to the original user, provided always that
in our sole judgment, the product is defective.
RPI of Indiana Inc. will supply without charge,
a similar genuine replacement for the defective
part on a product of our manufacture provided the
container has been in normal use and service and
properly maintained during this period.
RPI of Indiana Inc.'s warranty obligation in connection
with the sale of this equipment:
1. Shall be expressly limited to the repair and/or
replacement of defective parts, as stated above,
and covers only those labor charges specifically
authorized by the manufacturer, all other damages
and claims, statutory or otherwise, are hereby expressly
waived by the purchaser.
2. Shall not apply to any failure, damage or defect
caused by neglect, lack of maintenance, misuse,
abuse, improper installation, improper operation,
redesign or through any other cause, natural or
otherwise, beyond the control of the manufacturer.
3. Shall not apply if the equipment has been operated
beyond factory recommended limitations or used in
a manner that is inconsistent with the specification
& intended end-use stated at the time the order
was placed & accepted.
4. Does not cover products or accessories not supplied
by us or if supplied by us, then only to the extent
of any warranty provided by the original manufacturer.
THIS WARRANTY IS IN LIEU OF
ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, AND
THERE IS NO IMPLIED WARRANTY OF MERCHANTABILITY
OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT
SHALL RPI OF INDIANA INC. ASSUME LIABILITY FOR LOSS
OF PRODUCT, LOSS OF INCOME, TIME DELAYS OR ANY OTHER
CONSEQUENTIAL DAMAGES. |
